We are committed to handling personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth), the Privacy (Tax File Number) Rule 2015, the Tax Agent Services Act 2009 (Cth), the Tax Agent Services (Code of Professional Conduct) Determination 2024, and the professional and ethical standards of CPA Australia.
This policy describes how we collect, hold, use, disclose, and protect your personal information. It applies to all clients, prospective clients, employees of clients, and other individuals whose information we handle in connection with our services.
The Types of Personal Information We Collect
We collect a range of personal information to ensure we can provide high quality, professional accounting and taxation services. Depending on the nature of the services we provide to you, this may include:
- Personal identification details such as your name, date of birth, gender, and contact details (postal and residential addresses, telephone numbers, and email addresses)
- Tax File Numbers (TFNs) and other government-issued identifiers such as Australian Business Numbers (ABNs)
- Financial information including details of income, expenses, assets, liabilities, investments, bank accounts, superannuation, and insurance
- Employment details and history
- Business and company information, including details of trusts, partnerships, and corporate structures
- Information about your spouse, dependants, or business associates where relevant to the services we provide
- Sensitive information as defined under the Privacy Act, which may include health information or professional memberships where necessary for specific advice
- Bank account and payment details for billing and refund purposes
You may choose not to provide certain information. However, this may limit the services we are able to provide. Due to the nature of our work, it is generally not practical to deal with us on an anonymous or pseudonymous basis.
How We Collect Your Information
In most cases, we collect personal information directly from you. This may occur face to face, by telephone, through written correspondence (including email), when you complete forms or questionnaires, or through our website.
In some cases, we may collect personal information from third parties with your consent, including from your employer (where they are the client), the Australian Taxation Office, financial institutions, legal representatives, or other professional advisors you have authorised us to deal with.
Tax File Number Information
We take the handling of Tax File Number information very seriously. TFNs are collected only for purposes authorised under taxation, superannuation, or personal assistance law. When we request your TFN, we will inform you of the legislative authority for the request, the purpose of the collection, and the consequences of choosing not to provide it. Providing your TFN is voluntary, but not providing it may result in tax being withheld at higher rates or delays in processing.
Your TFN is never used as a general client identifier within our systems. Access to TFN information is restricted to authorised personnel who require it for the specific purposes for which it was collected. TFN information is stored securely and is destroyed or permanently de-identified when it is no longer required for an authorised purpose or by law.
In the event of a data breach involving TFN information that is likely to result in serious harm, we are required to notify the Office of the Australian Information Commissioner and affected individuals in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988.
Why We Collect, Use, and Disclose Your Information
We collect, hold, and use personal information for the primary purpose of providing professional accounting, taxation, and advisory services. More specifically, this includes:
- Preparing and lodging tax returns, business activity statements, and other statutory documents
- Providing accounting, bookkeeping, business advisory, and financial planning services
- Communicating with you about your affairs, our services, and relevant developments in taxation or business law
- Complying with our obligations under taxation law, the Tax Agent Services Act 2009, and other applicable legislation
- Maintaining accurate records of the services we have provided
- Internal administration, quality assurance, and training purposes
We do not sell, rent, or trade your personal information to third parties. We will not disclose your personal information to any third party without your permission unless we are required or authorised to do so by law.
We may use your contact details to send you information about our services, industry updates, or newsletters that we believe may be relevant to you. You may opt out of receiving these communications at any time by contacting us.
Who We May Disclose Your Information To
In the course of providing our services, we may need to disclose your personal information to the following categories of third parties:
- The Australian Taxation Office and other government agencies as required by law
- State and territory revenue authorities
- The Australian Securities and Investments Commission (ASIC)
- Software and technology providers that support our practice operations, including cloud-based accounting, document management, and practice management platforms
- Our professional indemnity insurers, where required
- Other professional advisors you have authorised us to deal with on your behalf, such as lawyers, financial planners, or mortgage brokers
- External contractors or service providers engaged by us to assist in delivering our services, who are bound by confidentiality obligations
We will not disclose your information to any third party for the purpose of allowing them to send marketing material to you.
Overseas Disclosure
Some of the software platforms and cloud services we use may store or process data on servers located outside Australia, including in the United States, the European Union, and other jurisdictions. Where this occurs, we take reasonable steps to ensure that overseas recipients handle your personal information in a manner consistent with the Australian Privacy Principles. If we need to transfer your information overseas for any other reason, we will seek your consent before doing so.
How We Protect Your Information
We take the security of your personal information seriously and have implemented physical, technical, and organisational measures to protect it from misuse, interference, loss, unauthorised access, modification, and disclosure. These measures include:
- Secure office premises with restricted access
- Password-protected systems and encrypted data storage
- Access controls that restrict information to authorised personnel
- Regular review of our information security practices
- Staff training on privacy and confidentiality obligations
While we take all reasonable precautions, no data transmission over the internet or method of electronic storage can be guaranteed as completely secure. How Long We Keep Your Information
We retain client records for a minimum of five years from the date of the last service provided, as required under the Tax Agent Services (Code of Professional Conduct) Determination 2024. Some records may be retained for longer periods where required by other legislation, including taxation law. When personal information is no longer required for any authorised purpose or by law, it is securely destroyed or permanently de-identified.
Accessing and Correcting Your Information
You have the right to request access to the personal information we hold about you and to request corrections if you believe any of that information is inaccurate, incomplete, or out of date. To make a request, please contact us using the details below. We may ask you to verify your identity before providing access.
We will respond to access and correction requests within a reasonable timeframe. In limited circumstances, we may refuse access where permitted by law, for example where granting access would unreasonably impact on the privacy of another individual. If we refuse a request, we will provide written reasons.
It is important that you let us know promptly if your personal details change so that we can keep our records accurate and up to date.
Tax Practitioners Board
Aurum Accounting Group is a registered tax agent practice. The Tax Practitioners Board (TPB) maintains a public register of registered, suspended, and deregistered tax and BAS agents. You can search this register at https://www.tpb.gov.au/public-register.
Our services are governed by the Tax Agent Services Act 2009, the Code of Professional Conduct, and the Tax Agent Services (Code of Professional Conduct) Determination 2024. For general information about the rights, responsibilities, and obligations of registered tax practitioners and their clients under the taxation laws, please refer to our engagement letter or contact us directly.
In regard to paragraphs 45(1)(d) and 45(1)(e) of the Tax Agent Services (Code of Professional Conduct) Determination 2024, we do not have any prescribed events within the last five years to disclose, and there are no conditions currently imposed on our registration.
